| Dear #firstname#, In a recent case the ATO claimed a taxpayer was an Australian Resident and sought to amend their tax returns for several years. The taxpayer had been living in Malaysia for this period, was employed there and had set up an apartment. He did return to Australia several times a year to visit family and when he completed the airline passenger cards he wrote "resident" and the ATO tried to use this as proof that he was in fact a resident. The taxation tribunal found that the purpose of the cards was not to establish taxation status and the ATO lost the case we find it interesting to see how widespread their sources of information are becoming.
